Anti-Discrimination and Hate Speech Policy

UAartsy prohibits the use of our Services to discriminate against people based on the following personal attributes (collectively, “protected groups”):

  • Race
  • Color
  • Ethnicity
  • National origin
  • Religion
  • Gender
  • Gender identity
  • Sexual orientation
  • Disability
  • Any other characteristic protected under applicable law

Additionally We do not allow hate speech. Hate speech occurs when violent, offensive, derogatory or demeaning language is directed at a person or group based on their one or more protected group attributes.

As a seller on UAartsy, your shop content and shop policies, cannot display discriminatory behavior toward protected groups. Examples of prohibited behavior include, but are not limited to:

  • Refusal of service based on membership in one or more protected group
  • Expressing intolerance or a lack of respect for another member on the basis of protected group attributes
  • Having a shop policy that excludes sales to members of one or more protected groups listed above
  • Directly or indirectly making derogatory or demeaning remarks against protected groups listed above
  • Racial slurs
  • Posts that support or glorify hate groups and their members

Community Policy

  • UAartsy community spaces are public areas where sellers can interact with one another. Sellers who use any of the community spaces must be over 18 years old.
  • Don't engage in illegal activity or activity that infringes someone's intellectual property, or encourage others to engage in that type of activity. 
  • Don't spam. This includes unsolicited or duplicate posts or links to your shop, fundraisers, surveys, social media or other promotional content. 
  • Don't use community tools or spaces to interfere with another seller’s business. 
  • Be honest and transparent about who you are. Don't use a fake identity.

Payment Policy

UAartsy allows sellers to (a) accept payment by authorized credit and debit card transactions, some bank transfers services, PayPal (where available), transactions using Apple Pay, and transactions using Google Pay, (b) have those funds credited to a seller’s payment account with UAartsy, and (c) have those funds deposited into a seller’s designated bank account.

UAartsy is only available to sellers who are at least 18 years old who register and are approved for a payment account with UAartsy. Sellers must be US Residents with U.S. Bank Accounts.

Buyers may authorize a payment with any major credit or debit card accepted by UAartsy, by certain bank transfer services, or through PayPal (where available), Apple Pay, or Google Pay.

Please note that bank or card providers may charge additional fees (including cross-border fees) for transactions that are made on UAartsy. These fees are not charged by UAartsy and are at the discretion of your bank. Please contact your bank for further details.

Each seller appoints UAartsy as its agent for the limited purpose of receiving, holding, and settling payments to seller. UAartsy will settle payments that are actually received by UAartsy to each seller, less any amounts owed to UAartsy and subject to these Terms. Each seller agrees that a buyer payment received by UAartsy, on behalf of seller, satisfies the buyer's obligations to make payment to seller, regardless of whether UAartsy actually settles such payment to seller. If UAartsy does not settle any such payments as described in these Terms to a seller, such seller will have recourse only against UAartsy and not the buyer.

Payment Account. All funds resulting from a completed transaction will be reflected as a balance in a seller’s payment account. Transactions are considered complete at the later of once the payment is approved by UAartsy or our fraud analysis service provider. Any refunds, adjustments, or other amounts paid to buyers in connection with purchases, or for funds received since the last payment day, are also applied to the seller’s payment account balance. Funds in a payment account balance are eligible for deposit (the “Available Funds”) into a seller’s bank account at the end of any applicable deposit delay, reserve, or hold period as determined by the seller’s bank.

Available Funds can only be deposited into bank accounts, in the domestic currency of the account in the United States. 

Payment Processing

UAartsy charges a fee (the “Global Sales Commission”) for processing each transaction through UAartsy. The fee amount will be assessed on the gross order amount (not shipping and tax). The Global Sales Commission will be reflected in your payment account and will be deducted from the total amount of the payment at the time the payment is considered complete. We reserve the right to modify this fee at any time.

In the event of any partial or full refunds credited back to a buyer, the Global Sales Commission and other applicable fees will be recalculated based on the adjusted sale price. The difference between the original Global Sales Commission and the adjusted Global Sales Commission will be applied to the refund amount being credited back to the seller. Other applicable fees will be refunded to the seller's payment account. 

Fee Amount

You might be wondering how much this costs you to have your own online store? Here is the breakdown:

Your Cost After Selling = Tax + Global Sales Commission

  • Tax – Buyers will pay you tax directly into your PayPal or Bank Account. You will need to pay this on your own.
  • Global Sales Commission per sale –0.30¢+ 5% sales commission +2.9% Transaction Fee

Reporting Obligations

Internal Revenue Service regulations require that we file a Form 1099-K to report unadjusted annual gross sales information for sellers located in the United States or being paid in USD in certain circumstances.

Termination

Sellers may terminate this contract and their acceptance of UAartsy payments at any time by adjusting the Settings in their account. UAartsy may also terminate or suspend a seller’s use of UAartsy at any time.

Upon termination, any non-disputed Available Funds will be deposited into a seller’s bank account. UAartsy reserves the right, upon termination of access to UAartsy Payments, to set off against any payments to be made to the seller, an amount determined by us to be adequate to cover any anticipated chargebacks, refunds, adjustments, or other amounts that might be paid to buyers in connection with purchases from the seller's payment account for a prospective 180-day period. At the end of the 180-day period following termination, we will disburse to the seller any amount not used to offset chargebacks, refunds, adjustments, or such other amounts paid to buyers, or seek reimbursement from the seller via any of the means authorized in this Policy for any additional amount required to offset chargebacks, refunds, adjustments, or other amounts paid to buyers, as applicable.

Refunds

UAartsy is a venue made up of independent sellers who run their own shops. This means that each seller is responsible for their own policies regarding refunds, exchanges, and returns. Individual policies will vary from shop to shop.

As a seller on UAartsy, you’re expected to clearly state your policies regarding returns and refunds in your shop policy, This includes:

  • Whether or not you accept returns
  • The time frame in which you may accept a return
  • Who will pay for the cost of return shipping for any items that are sent back to you.

If you do have a problem with a transaction, it’s best to contact the buyer directly. Buyers are also encouraged to contact you if they experience any issues.
